Ifeanyi Ejiofor, the lead attorney for Mazi Nnamdi Kanu, the leader of the Biafra Indigenous People, IPOB, has accused the Federation Attorney General Abubakar Malami of terrorism.
He said Malami and his accomplices had violated both Nigerian and international laws for the way in which the extradition and rendition of Kanu had been handled in this way and committed an act of terrorism under the same law they broke.
Kanu’s lawyer said in a statement on Wednesday.
The statement read: “The Honorable Federation Attorney General Abubakar Malami (SAN) is aware of the existence of this Nigerian Extradition Act, Cap E25, Federation Laws 2004, particularly the mandatory provision of Section 15 of this Extradition Act.
“Nevertheless, he committed a gross violation of this law by participating in the criminal kidnapping of Kenya’s Mazi Nnamdi Kanu and extraordinarily extraditing him to Nigeria instead of subjecting him to the extradition procedure also provided for under Kenyan law. ”
Ejiofor further questioned why Kanu’s extradition proceedings differed from those of suspended Deputy Police Commissioner Abba Kyari, saying that Kanu did not receive the same treatment Kyari received as he was subjected to extradition proceedings before a court.
“It is important to note that the same AGF also subjected the disgraced and suspended AKP Abba Kyari to the same extradition process in the Nigerian court.
“Why was Nnamdi Kanu not given the same opportunity before being forcibly transferred to Nigeria?
“The law is now clear that the Attorney General of the Federation and his accomplices committed an act of terrorism in their own right for violating international law with impunity in the violent kidnapping and transfer of Mazi Nnamdi Kanu in Nigeria.
“It should also be noted that Mazi Nnamdi Kanu is a victim of terrorism under the provisions of another Nigerian law under Section 2(3)(f) of the Terrorism Prevention (Amendment and Prohibition) Act, 2022. Abubakar Malami SAN is also aware of the provisions of this law.
“In a healthier and more civilized society, the Attorney General of the Federation and his accomplices would be in prison to cool off for their blatant violation of Nigerian laws, which constitutes an act of terrorism.
Unfortunately, however, we find ourselves in a land of “anyway” where anything is possible.
“The freedom of Onyendu Mazi Nnamdi Kanu is sacrosanct and the hour has come, there is no turning back,” he added.
